Acceptable Use Policy

1. Core principles

You must use the Service lawfully, responsibly and in good faith. You must not use the Service to harm people, infringe rights, evade the law, or undermine the security or integrity of Nexpher Limited, our users, or third parties.

You are responsible for Output and agents you create, publish or expose, including how third parties interact with public agents and APIs under your control.

2. Prohibited uses

You may not use the Service to, or to assist others to:

• Violate any applicable law, regulation, sanctions regime or court order.
• Exploit, abuse, groom, or harm children, or generate or distribute child sexual abuse material (real or fictional).
• Engage in trafficking, sexual exploitation, non-consensual intimate imagery, or stalking.
• Promote or facilitate violent crime, terrorism, violent extremism, or the manufacture or acquisition of illegal weapons or explosives.
• Develop, distribute or operationalise malware, ransomware, botnets, phishing kits, credential-stealing tools or other cyber-offensive tooling intended to compromise systems without authorisation.
• Conduct unauthorised access, intrusion testing, scanning or exploitation of systems you do not own or have explicit permission to test — including against Nexpher Limited infrastructure.
• Commit fraud, identity theft, social-engineering scams, or create deceptive content intended to mislead others about material facts (including deepfakes used for fraud or impersonation of real individuals without lawful basis and required disclosures).
• Spam, bulk-unsolicited messaging, or manipulate engagement metrics.
• Infringe intellectual property, privacy, publicity or other rights of third parties.
• Harass, threaten, dox, or incite violence or unlawful discrimination against individuals or protected groups.
• Provide tailored advice that would constitute regulated professional practice (legal, medical, investment or similar) without appropriate human professional oversight and required licences.
• Attempt to reverse engineer, extract, or exfiltrate model weights, training data of others, system prompts of third-party agents, or proprietary components of the Service except as permitted by mandatory law.
• Resell raw undifferentiated model access in a manner that circumvents plan limits or our marketplace rules, or that misrepresents affiliation with Nexpher Limited.
• Overload, disrupt or interfere with the Service or third-party providers (including denial-of-service activity).
• Misrepresent Output as solely human-authored where disclosure is legally required, or use the Service to evade platform authenticity rules.

3. High-risk and restricted uses

Unless you have obtained our prior written consent and implemented appropriate human oversight, safety controls and legal compliance, you must not use the Service for:

• Autonomous control of vehicles, weapons, industrial machinery, or critical infrastructure.
• Emergency response, medical diagnosis or treatment decisions without a qualified professional in the loop.
• Automated decisions that produce legal or similarly significant effects on individuals (for example credit, employment, housing, insurance or immigration) without meaningful human review and compliance with applicable law.
• Biometric identification or categorisation for law-enforcement or surveillance purposes where restricted by law.
• Political campaigning that violates local election or advertising laws.

4. Marketplace and public agents

Creators must accurately describe agent capabilities and limitations, must not list agents designed primarily for prohibited uses, and must promptly address reports of harmful behaviour. End users must not abuse marketplace agents or attempt to jailbreak them into prohibited behaviour at scale.

Nexpher Limited may remove listings, revoke API access, withhold earnings related to violative activity, and preserve evidence as required by law.

5. Credentials and rate limits

Do not share API keys publicly, scrape the Service beyond documented interfaces, or circumvent rate limits, quotas, billing or security controls. Automated access must respect our documentation and any robots or technical restrictions we publish.

6. Enforcement

We may investigate suspected violations using logs, reports and other lawful means. We may remove Content, restrict features, suspend or terminate accounts, and notify affected parties or authorities where appropriate. We are not obligated to monitor all Content but reserve the right to do so for safety, security and compliance.

7. Changes

We may update this AUP from time to time. Continued use of the Service after the effective date constitutes acceptance. Material changes will be indicated by updating the date on this page and, where practicable, by additional notice.
